These Terms & Conditions (“Terms”) constitute a legal agreement between you (“User,” “you,” or “your”) and BigBurry Hypersystems (“BigBurry,” “we,” “our,” or “us”), a company incorporated under the laws of India, governing your access to and use of the QuickVote platform, mobile applications, website, and related services (collectively referred to as the “Platform”).

By using or accessing QuickVote, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our services.


 

1. Overview

 

QuickVote is an online election and voting platform that allows individuals, institutions, organizations, and communities to conduct secure, transparent, and auditable elections through the web and mobile devices.

BigBurry Hypersystems provides the technical infrastructure, software, and related services but does not control or endorse the specific content, rules, or outcomes of any election created on the Platform.


 

2. Definitions

 
  • “Account” means a registered user account created on QuickVote.

  • “Election Organizer” or “Organizer” means the person or institution that creates or manages an election.

  • “Voter” means a participant invited or authorized to vote in an election.

  • “Candidate” refers to a participant standing for election.

  • “Content” means all information, text, graphics, videos, or materials uploaded, posted, or transmitted through QuickVote.

  • “Services” means all products, features, and tools offered through QuickVote.

  • “Private Election” refers to elections that restrict voter access or require authentication.

  • “Public Election” refers to open-access elections available for public participation.


 

3. Eligibility

 

By accessing or using QuickVote, you represent that:

  1. You are at least 16 years of age or of legal age to enter into binding contracts under applicable law.

  2. You are authorized to act on behalf of an institution, if applicable.

  3. You will comply with all applicable laws, regulations, and these Terms.

If you are under the age of 16, you may not use QuickVote unless supervised by a parent or legal guardian who consents to these Terms.


 

4. Acceptance of Terms

 

Your use of QuickVote constitutes acceptance of these Terms, along with our Privacy Policy, which is incorporated by reference.
If you are using QuickVote on behalf of an organization, you agree that you are authorized to bind that organization to these Terms.

BigBurry reserves the right to update or modify these Terms at any time without prior notice.
Updated Terms will be published on the website, and continued use of the Platform constitutes acceptance of the changes.


 

5. Account Registration

 

To use certain features of QuickVote, you must create an account. When registering:

  • You must provide accurate, complete, and current information.

  • You are responsible for maintaining the confidentiality of your account credentials.

  • You agree to notify us immediately of any unauthorized use of your account.

  • You are solely responsible for activities conducted under your account.

BigBurry reserves the right to suspend or terminate accounts that violate these Terms or provide false information.


 

6. User Responsibilities

 

You agree not to use QuickVote for any unlawful or unethical purpose. You shall not:

  1. Use QuickVote to conduct or promote fraudulent, defamatory, or discriminatory elections.

  2. Upload or transmit any content that infringes on intellectual property rights.

  3. Circumvent or attempt to manipulate voting systems, audit logs, or result data.

  4. Interfere with the security, integrity, or performance of the Platform.

  5. Create multiple accounts to mislead or influence election outcomes.

  6. Engage in harassment, impersonation, or misleading communication within the platform.

Violations may result in account suspension, data removal, or legal action.


 

7. Service Availability

 

BigBurry aims to provide uninterrupted access to QuickVote but does not guarantee 100% uptime.
Temporary service interruptions may occur due to:

  • Scheduled maintenance,

  • Technical issues beyond our control,

  • Network or hosting disruptions (AWS, Firebase), or

  • Force majeure events (natural disasters, cyberattacks, etc.).

We are not liable for any loss or inconvenience caused by such interruptions, though we will make reasonable efforts to restore service promptly.


 

8. Election Setup and Management

 

8.1 Organizer Responsibility

 

Each Organizer is solely responsible for:

  • Election setup, content, rules, and integrity.

  • Ensuring the election complies with applicable laws.

  • Verifying eligibility of voters.

  • Communicating clearly with voters regarding the election process.

BigBurry is not responsible for verifying election legitimacy, voter eligibility, or result accuracy beyond the technical scope of the platform.

8.2 Voter Responsibility

 

Each Voter agrees to:

  • Vote only once per authorized election.

  • Use provided access credentials responsibly.

  • Maintain confidentiality of their voting links or codes.


 

9. Free and Paid Services

 

QuickVote offers two primary service categories:

9.1 Public Elections (Free)

 
  • Open to anyone with a public link.

  • No authentication required.

  • Suitable for open community polls and informal events.

9.2 Private Elections (Paid)

 
  • Restricted access controlled by the Organizer.

  • Authentication via email, OTP, or verification list.

  • Includes detailed analytics and enhanced security.

10. Payments and Refunds

 

Payments for private elections are securely processed through Razorpay.
By making a payment, you agree to Razorpay’s terms and BigBurry’s policies.

  • All fees are in INR unless otherwise specified.

  • Taxes may apply based on your region.

  • Once an election has started, payments are non-refundable, except in the case of verified technical failure attributable to BigBurry.

  • Refunds (if applicable) will be issued within 10–15 business days after review.


 

11. Intellectual Property

 

All intellectual property rights in QuickVote — including software code, trademarks, designs, databases, text, graphics, and logos — are owned exclusively by BigBurry Hypersystems.

Users are granted a limited, non-exclusive, non-transferable license to use QuickVote solely for legitimate elections and internal purposes.

You may not:

  • Copy, reverse-engineer, distribute, or modify any part of the platform.

  • Use the QuickVote logo or name without prior written consent.

  • Build a competing product based on our software or designs.


 

12. User-Generated Content

 

You retain ownership of any content you upload, including election data, candidate profiles, or media.
By submitting such content, you grant BigBurry a worldwide, royalty-free, non-exclusive license to host, process, and display the content solely for the purpose of operating the platform.

You are solely responsible for ensuring that your content:

  • Does not infringe third-party rights.

  • Is lawful, accurate, and ethical.

  • Does not contain false, defamatory, or misleading information.


 

13. Confidentiality and Anonymity

 

BigBurry is committed to maintaining election confidentiality and voter anonymity.
All votes are encrypted and anonymized immediately after submission.
Election results are displayed in aggregate form only, without linking to individual users.

Organizers must handle their voter data responsibly and in compliance with local data protection laws.


 

14. Data Privacy and Protection

 

Our data collection, processing, and retention practices are detailed in the Privacy Policy, which forms an integral part of these Terms.

By using QuickVote, you consent to the collection and use of data as described in that policy.


 

15. Third-Party Services

 

QuickVote integrates with third-party providers, including:

  • Google Analytics – for aggregate usage analytics.

  • Firebase – for notifications and OTP services.

  • Razorpay – for secure payment processing.

  • Amazon Web Services (AWS) – for cloud hosting and data storage.

These services have their own privacy and terms of use. BigBurry is not responsible for their independent practices but ensures compliance with data protection regulations.


 

16. Prohibited Activities

 

Users agree not to engage in any of the following:

  • Using the platform for political, extremist, or hate-based purposes.

  • Distributing viruses, bots, or malicious scripts.

  • Attempting unauthorized access to our servers or databases.

  • Engaging in data scraping or unauthorized data extraction.

  • Violating intellectual property or privacy rights of others.

Any violation may result in account termination and legal action.


 

17. Disclaimer of Warranties

 

QuickVote is provided “as is” and “as available.”
BigBurry makes no representations or warranties regarding:

  • The accuracy or completeness of election results.

  • Continuous availability or error-free operation.

  • Fitness of the platform for any particular election type or jurisdiction.

We disclaim all implied warranties to the fullest extent permitted by law.


 

18. Limitation of Liability

 

To the maximum extent permitted by law, BigBurry shall not be liable for:

  • Any direct, indirect, incidental, consequential, or punitive damages.

  • Loss of data, profits, or goodwill resulting from your use of QuickVote.

  • Errors, delays, or failures caused by external services (AWS, Razorpay, Google, etc.).

  • Unauthorized access or alteration of election data beyond our reasonable control.

In no event shall BigBurry’s total liability exceed the amount paid by the user for the election service in question.


 

19. Indemnification

 

You agree to indemnify, defend, and hold harmless BigBurry Hypersystems, its directors, officers, employees, and affiliates from any claim, loss, damage, or expense arising out of:

  • Your violation of these Terms.

  • Your misuse of QuickVote.

  • Content or data you upload that infringes third-party rights.

This indemnity survives termination of your account or these Terms.


 

20. Suspension and Termination

 

BigBurry may suspend or terminate your account at any time if:

  • You violate these Terms or applicable laws.

  • You engage in fraud, misconduct, or abuse of the platform.

  • Your activity poses a security risk to the system or other users.

Termination may result in deletion of data and revocation of access.
You may terminate your account voluntarily by contacting support@bigburry.com.


 

21. Compliance with Laws

 

You agree to comply with all applicable laws, including:

  • The Information Technology Act, 2000 (India),

  • GDPR (European Union),

  • CCPA (California, USA), and

  • Any regional election or privacy regulations relevant to your use.

QuickVote is not intended to replace statutory election systems governed by national election authorities.


 

22. Force Majeure

 

BigBurry shall not be liable for any delay or failure to perform due to events beyond our reasonable control, including but not limited to:

  • Natural disasters, wars, strikes, cyberattacks, power failures, or regulatory changes.

Such events shall not constitute a breach of these Terms.


 

23. Dispute Resolution

 

Any dispute or claim arising from these Terms shall be resolved as follows:

  1. Negotiation: The parties will first attempt amicable resolution via written communication.

  2. Mediation: If unresolved within 30 days, disputes may proceed to confidential mediation.

  3. Jurisdiction: If still unresolved, the matter shall be subject to the exclusive jurisdiction of the Courts of Kerala, India.

For users outside India, we will comply with applicable international dispute frameworks as required by law.


 

24. Governing Law

 

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
If any provision is held invalid by a court, the remaining provisions shall remain enforceable.


 

25. Notices and Communication

You agree to receive legal notices and service updates electronically through email or within the platform.


 

26. Severability

 

If any part of these Terms is found to be invalid or unenforceable, that portion shall be limited or eliminated to the minimum extent necessary.
The remaining provisions will continue in full force and effect.


 

27. Entire Agreement

 

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BigBurry Hypersystems.
They supersede all prior agreements, understandings, or communications related to QuickVote.


 

28. Waiver

 

Failure by BigBurry to enforce any provision of these Terms does not constitute a waiver of that provision or any other rights under this Agreement.


 

29. Changes to Terms

 

We may update these Terms periodically to reflect legal, technical, or business changes.
Updated versions will be published on the QuickVote website with the “Last Updated” date revised accordingly.

Your continued use of the Platform after such changes constitutes your acceptance of the updated Terms.
